Scope
These General Terms and Conditions (hereinafter "GTC") apply to all services offered by Paw & Property KlG (hereinafter "P&P") for the website www.maisonBo.ch and its maisonBo brand in Switzerland. By using the services of P&P, you (hereinafter referred to as "Customer") accept the following terms and conditions in full and without modification. The current version of the GTC published at the time of conclusion of the contract shall apply. Contract amendments, subsidiary agreements, and the Customer's terms and conditions shall only become part of the contract after written acceptance by P&P.

Data protection and copyright
The customer hereby agrees that P&P is permitted to use the personal information provided by the customer. The privacy policy forms the basis for the corresponding use of personal information and is an integral part of these terms and conditions.
All content provided by P&P is protected by copyright.

Online Shop
3.1 Service area and offer
As a reseller, P&P supplies third-party products under the brand name maisonBo throughout Switzerland. Accessories, decorations, and similar items shown in the product images are not included in the offer, unless expressly stated otherwise. We reserve the right to make minor deviations in color, workmanship, and structure from the products shown in the online shop.
3.2 Conclusion of the contract
When purchasing or ordering P&P products in the online shop, the customer submits a legally binding offer to conclude a contract by accepting the terms and conditions and privacy policy and then submitting the order. P&P confirms receipt of the order by email after receiving the order. The contract is only considered concluded upon receipt of this confirmation. The conclusion of the contract is subject to the availability of the ordered products. The goods remain the property of P&P until full payment has been received. If the ordered product is not available, P&P will inform the customer accordingly.
3.3 Payment methods

3.4 Delivery
Deliveries are made by Swiss Post or another parcel delivery service. Delivery times are shown at checkout and are estimates only. Custom-made items are delivered within 4–8 weeks. P&P is not liable for any delivery delays and/or damages incurred as a result.
3.5 Inspection of goods / Notice of defects
Customers shall check the goods for completeness and integrity immediately upon receipt. Any defects discovered at a later date must be reported to P&P immediately upon discovery. P&P reserves the right to remedy defects. Only if this is not possible will a new product be sent to the customer or a refund granted. Non-defective goods are excluded from exchange or refund.
3.6 Disclaimer regarding products, installation and use
The products offered via maisonBo.ch are sourced from various manufacturers. P&P acts solely as a reseller and is neither the manufacturer nor the developer of the products on offer. All product-specific features, safety requirements, warranty terms and liability provisions are generally subject to the respective terms and conditions, installation instructions and warranty provisions of the relevant manufacturer.
The customer is obliged to familiarise themselves with the relevant manufacturer’s instructions, safety guidelines and the applicable warranty and terms of use prior to installing and using a product, and to comply with them. In particular, for products with mechanical components or vehicle accessories - such as boarding aids or dog steps - the customer is solely responsible for correct installation, checking compatibility with the relevant vehicle, and ensuring proper and safe use.
To the extent permitted by law, P&P accepts no liability for damage arising from the installation, use or improper use of the products offered. This applies in particular to damage to vehicles, vehicle parts, interior fittings, mounting points or other objects, as well as to injury to persons or animals. Use of the products is always at the customer’s own risk. The customer remains responsible at all times for the safe use of the products and for the supervision and control of their pet.
Any warranty, liability or guarantee claims arising from product-specific characteristics, material defects or design features shall be governed - to the extent permitted by law - by the manufacturer’s respective warranty and liability terms and conditions.
To the extent permitted by law, P&P’s liability shall in all cases be limited to the purchase price paid by the customer for the product in question. This is subject to mandatory statutory provisions, in particular in the event of a breach of duty caused by wilful misconduct or gross negligence.
3.7 Warranty and Guarantee
Warranty
The statutory warranty under Swiss law applies.
maisonBo.ch reserves the right to fulfil the warranty at its own discretion by providing a replacement, carrying out repairs or refunding the purchase price.
To the extent permitted by law, any further claims – in particular rescission and reduction – are excluded.
Manufacturer’s warranty
Additional manufacturer’s warranties may apply to individual products. These are provided exclusively by the respective manufacturer and are subject to their warranty terms (usually 1 year, unless otherwise stated).
Paw & Property does not provide its own warranty.
Handling of warranty claims
In the event of a warranty claim, maisonBo.ch is happy to assist customers in contacting and dealing with the relevant manufacturer.

Prices
All prices quoted in CHF include VAT and other statutory charges, but - unless otherwise stated - exclude delivery and installation costs.

Final provisions
6.1 Swiss law applies exclusively, excluding conflict of law provisions and the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Basel.
6.2 The customer may only offset legally established and undisputed claims against P&P.
6.3 P&P reserves the right to change these Terms and Conditions at any time. Changes will be made available on the website and will come into effect as soon as they are published.
6.4 Should individual or multiple provisions of these General Terms and Conditions be or become invalid or unenforceable in whole or in part, this shall not affect the validity or enforceability of the remaining provisions of these General Terms and Conditions. In this case, the parties shall replace the invalid or unenforceable provision with a valid and enforceable provision that comes closest to the economic purpose of the provision to be replaced. The same shall apply mutatis mutandis in the event that these General Terms and Conditions contain a loophole.
6.5 If the English version of the Terms and Conditions differs from the German version, the German version shall apply.
